1. DEFINITIONS

• "Company" refers to Orso Solutions LLC
• "Service" refers to booda.ai, including:
  • Website
  • iOS App (Apple App Store)
  • Android App (Google Play, current or future)
  • Voice AI systems
  • APIs, servers, models, and outputs
• "AI" refers to the voice-based artificial intelligence system
• "User" refers to any individual or entity accessing the Service

2. ACCEPTANCE OF TERMS (AUTOMATIC & IMPLIED)

You agree that:

• Use of the Service constitutes explicit consent
• No physical signature is required
• Consent applies retroactively and prospectively
• Continued use equals acceptance of any future updates

CREATING AN ACCOUNT IS NOT REQUIRED TO BE BOUND BY THESE TERMS.

3. PLATFORM COVERAGE (WEBSITE + MOBILE APPS)

These Terms apply to ALL ACCESS METHODS, including but not limited to:

• booda.ai website
• Apple App Store iOS application
• Google Play Android application
• Beta, alpha, private, or test builds
• Any future platforms or devices

booda.ai is a voice-based artificial intelligence system that:

• Speaks dynamically
• Expresses opinions
• Generates responses that may be controversial
• Produces speculative, philosophical, or abstract content

THE AI IS NOT HUMAN.

THE AI HAS NO INTENT, DUTY, OR RESPONSIBILITY.

5A. SAFETY WARNING - DO NOT USE WHILE DRIVING OR OPERATING VEHICLES

FOR YOUR SAFETY AND THE SAFETY OF OTHERS:

• DO NOT use booda.ai while driving any vehicle (car, truck, motorcycle, bicycle, etc.)
• DO NOT use booda.ai while operating any machinery or equipment
• DO NOT listen to booda.ai audio/music while driving or operating vehicles
• DO NOT engage with the Service in any situation where distraction could cause harm

Using booda.ai requires your full attention. Distracted driving is dangerous and illegal in many jurisdictions.

YOU ASSUME ALL RISK AND LIABILITY FOR ANY USE WHILE DRIVING OR OPERATING VEHICLES.

6. "TRUTH-SPEAKING" DISCLAIMER

booda.ai may be described as a truth-speaking AI, HOWEVER:

• "Truth" is subjective
• AI outputs may be:
  • Incorrect
  • Incomplete
  • Misleading
  • Offensive
  • Disturbing
  • Emotionally impactful
• The AI does not verify facts
• The AI does not guarantee accuracy

YOU EXPRESSLY AGREE THAT:

• Whatever the AI says is NOT advice
• Whatever the AI says is NOT a statement of fact
• Whatever the AI says is NOT endorsed by the Company
• Whatever the AI says is YOUR responsibility to interpret

7. ABSOLUTE NO-ADVICE DISCLAIMER

UNDER NO CIRCUMSTANCES DOES BOODA.AI PROVIDE:

• Medical advice
• Legal advice
• Financial advice
• Investment advice
• Mental health advice
• Crisis or emergency services
• Spiritual or religious instruction
• Life-altering guidance

DO NOT USE BOODA.AI IN EMERGENCIES.

DO NOT RELY ON BOODA.AI FOR DECISIONS.

8. ASSUMPTION OF ALL RISK

YOU VOLUNTARILY AND KNOWINGLY ASSUME ALL RISKS, INCLUDING BUT NOT LIMITED TO:

• Emotional distress
• Psychological reactions
• Financial loss
• Physical harm
• Reputational damage
• Legal consequences
• Relationship or employment consequences

THE COMPANY DISCLAIMS ALL RESPONSIBILITY FOR OUTCOMES.

9. NO LIABILITY - MAXIMUM DISCLAIMER

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

ORSO SOLUTIONS LLC SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING:

• Direct damages
• Indirect damages
• Incidental damages
• Consequential damages
• Punitive damages
• Emotional or psychological harm
• Loss of income or opportunity
• Actions taken based on AI output

10. USER CONDUCT & MISUSE

You agree NOT to:

• Use the Service for illegal activity
• Attempt to manipulate or exploit the AI
• Attribute AI statements to the Company
• Use the Service where failure could cause harm

11. TERMINATION WITHOUT NOTICE

We reserve the absolute, unilateral right to:

• Suspend access
• Terminate accounts
• Remove content
• Block devices or IPs

WITHOUT NOTICE, REASON, OR REFUND.

12. PAYMENTS & BILLING

• All fees are final
• All payments are non-refundable
• Subscriptions renew automatically unless canceled

All rights, title, and interest in:

• AI models
• Voice outputs
• Branding
• Logos
• Software

belong exclusively to Orso Solutions LLC.

14. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• Accuracy
• Reliability
• Availability
• Fitness for any purpose

15. INDEMNIFICATION (VERY BROAD)

You agree to DEFEND, INDEMNIFY, AND HOLD HARMLESS Orso Solutions LLC from ANY AND ALL CLAIMS, including attorney's fees, arising from:

• Your use of the Service
• Your reliance on AI output
• Your violation of law
• Any third-party claims related to you

16. LIMITATION OF LIABILITY (HARD CAP)

MAXIMUM LIABILITY SHALL NOT EXCEED $100 USD OR THE AMOUNT YOU PAID IN THE LAST 30 DAYS — WHICHEVER IS LESS.

17. ARBITRATION & CLASS ACTION WAIVER

• ALL disputes resolved by binding arbitration
• NO jury trials
• NO class actions
• NO representative claims

18. GOVERNING LAW & VENUE

Governed exclusively by the laws of the Commonwealth of Puerto Rico.

Venue is Dorado, Puerto Rico.

19. SEVERABILITY

If any provision is held unenforceable, the remainder remains in full force.

20. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Orso Solutions LLC.
